1) Welcome

Song Wave Story turns your memories into personalised songs through a guided experience designed to feel premium, emotional, and low-risk. You can preview songs before paying, refine lyrics, and (if you want) generate extra versions to explore a different feel.

By using the Service or purchasing a Project, you agree to these Terms & Conditions (“Terms”). If you do not agree, please do not use the Service.

2) Key definitions

• “Project”: A personalised song project you create (occasion, inputs, lyrics, previews, final songs).
• “Inputs”: Everything you submit (names, memories, messages, pronunciations, dates, tone, etc.).
• “Lyrics Draft”: The AI-generated lyrics you review/edit before finalisation.
• “Preview Track”: A generated song preview you can listen to (currently up to 90 seconds per preview).
• “Preview Set”: A group of Preview Tracks generated in a round (typically 2 tracks per round).
• “Outputs”: The generated lyrics and audio created for your Project (previews and full songs).
• “Unlock”: Payment that enables you to download full songs and your lyric sheet.
• “Bonus Code”: A time-limited discount code issued after Unlock (currently valid for 24 hours, unless stated otherwise).

3) Eligibility and acceptable use

You must be legally able to enter into a binding contract where you live. You agree not to misuse the Service, including:

• Attempting to bypass limits, access controls, or payment steps
• Uploading unlawful or infringing content
• Using the Service for harassment, hate, exploitation, or deception
• Abusing free preview generation (for example, automated scraping, repeated farming, or fraudulent use)

We may restrict, suspend, or refuse service where we reasonably believe misuse, fraud, or policy breaches are occurring.

4) Accounts and magic-link login

You can begin as a guest. To access certain features (such as returning to a Project, downloading files, or managing your Project), we may use magic-link login to your email address. You are responsible for maintaining access to that email account and keeping magic links private.

5) The guided process (what you get before paying)

Our current flow is designed to let you confirm direction before paying.

5.1 Two previews (first round)

You generate 2 Preview Tracks, each available to listen to for up to 90 seconds.

5.2 Included changes round (second round)

If needed, you can request one included round of changes (for example: lyric tweaks, tone/style direction, pronunciation adjustments). This generates 2 additional Preview Tracks, each previewable for up to 60 seconds.

At this point you may have 4 Preview Tracks.

5.3 Optional extra previews (paid)

If you want more options, you may pay a small additional fee (shown at the time) to generate 2 more Preview Tracks, each previewable for up to 90 seconds.

At this point you may have 6 Preview Tracks.

5.4 Important note about previews

Previews are designed to help you choose direction (voice, vibe, style, arrangement). Because AI generation is probabilistic, the full songs may include:

• Minor stylistic variation versus the preview, and/or
• Occasional small pronunciation or performance differences, especially on phrases not prominent in the 90-second preview.

6) Unlock, downloads, and what you receive after payment

When you Unlock:

• You receive the full-length versions of the songs you previewed (i.e., 2, 4, or 6 songs depending on what you generated).
• You also receive a lyric sheet for your Project.

6.1 Minor lyric differences

In some cases, the final generation may adjust a word or phrasing very slightly (for example, to improve singability, rhythm, or flow). Any such changes are intended to be minimal and preserve the meaning and personal details of your story.

7) Pricing, currency, and taxes

• Prices may be shown and charged in a supported local currency based on your location at checkout.
• If we show alternative currency estimates, they are for convenience only. Your bank/card provider’s exchange rate and fees may differ.
• Taxes may apply depending on your location and local requirements; any applicable charges will be shown at checkout where required.
• If your preferred currency is not shown, you can use a standard online currency converter or contact us before purchase.

8) The 24-hour Bonus Code (post-purchase goodwill)

Because you own and download digital goods after Unlock, we generally do not offer refunds after Unlock (see Section 10). To support customer satisfaction, we may provide a high-discount Bonus Code after Unlock.

• The Bonus Code is typically valid for 24 hours from issuance (or as stated in your account).
• It is intended to let you generate another run (commonly 4 additional songs) at a significant discount if you want to explore a different pronunciation, voice, style, or production feel.
• Bonus Codes are non-transferable, have no cash value, and may not be combined with other offers unless stated.
• We may withhold or cancel a Bonus Code if we reasonably suspect fraud, abuse, chargebacks, or Terms breaches.

9) Storage, deletion, and your responsibility to download (14 days)

We keep your Project available for a limited time to let you download your files:

• We delete Project data (including Inputs and generated Outputs stored on our systems) after 14 days.
• You are responsible for downloading and backing up your songs and lyric sheet within that timeframe.
• Once downloaded, you can keep and use them forever (subject to these Terms).
• We may retain limited records required for legal, tax, accounting, and fraud prevention purposes (for example: payment confirmation and basic transaction metadata), even after Project deletion.

10) Refunds and cancellations (digital goods)

Because the Service provides custom digital content generated to your specification:

• No refunds are offered after Unlock (when full songs become available for download), except where required by applicable law.
• If you experience a genuine technical failure (for example, corrupted files or inability to download during the 14-day availability window), contact us and we will work with you on a reasonable remedy (such as re-providing files, regeneration, or another fix).

The preview-before-payment workflow and post-purchase Bonus Code exist specifically to reduce purchase risk.

11) Your Inputs – rights and responsibility

You retain all rights in your Inputs. You promise that:

• You have the right to provide your Inputs to us; and
• Your Inputs do not infringe anyone else’s rights or breach laws (including privacy laws).

You grant us a worldwide, non-exclusive, royalty-free licence to use your Inputs only to:

• Operate the Service and generate your Outputs
• Provide account access and downloads
• Improve reliability and prevent abuse
• Comply with legal obligations

12) Outputs (songs & lyrics) – your usage rights

Once you Unlock, you may use your purchased Outputs in any way you want, worldwide, forever, including personal and commercial use (for example: gifting, social media, YouTube, business use, promotions), provided that:

• You do not use the Outputs unlawfully
• You do not use the Outputs to harass, defame, or exploit others
• You do not use the Outputs in a way that suggests false endorsement by a real person/artist if that is not true
• You understand that Outputs are AI-generated and may sometimes share general similarities with genre conventions or common musical patterns.

13) Prohibited content

You must not use the Service to request, generate, upload, or share content that is:

• Illegal, hateful, harassing, exploitative, or violent
• Sexually explicit involving minors (zero tolerance)
• Designed to scam, defraud, or impersonate others
• Infringing on copyright/trademark or other rights
• Intended to dox, expose, or misuse personal information

We may refuse, remove, or restrict content that violates these Terms.

14) Privacy and security (summary)

We process personal information (including email, Project Inputs, and generated content) to provide the Service and magic-link access. We delete Project data after 14 days as described above. Payments are handled via Stripe; we do not store full card details on our servers.

15) Service changes, limits, and availability

We may change features, limits, preview lengths, pricing, included items, and generation options over time. We do not guarantee uninterrupted availability.

We may implement reasonable limits (rate limits, abuse checks, fairness controls) to protect the Service and users.

16) No guarantee of exact outcomes

AI generation is probabilistic. While we design the Service to produce high-quality songs, we cannot guarantee:

• A specific artistic result or exact sound
• Perfect pronunciation in all cases
• Identical results across generations

You can improve outcomes by providing clear Inputs, using pronunciation guidance, and reviewing previews before Unlock.

17) Suspension or termination

We may suspend or terminate access if we reasonably believe you have violated these Terms, engaged in fraud/abuse/chargebacks, or attempted to compromise platform integrity.

18) Limitation of liability

To the maximum extent permitted by law:

• We are not liable for indirect, incidental, special, consequential, or punitive damages.
• Our total liability for any claim relating to the Service is limited to the amount you paid for the relevant Project.
• Nothing in these Terms limits liability that cannot be excluded under applicable law.

19) Consumer law notice

If you are a consumer, you may have rights under the laws of your country that cannot be excluded by contract. For New Zealand consumers, this may include rights under the Consumer Guarantees Act 1993 (where applicable). These Terms operate subject to any non-excludable consumer rights.

20) Governing law and disputes

These Terms are governed by the laws of New Zealand. You agree that the courts of New Zealand have non-exclusive jurisdiction, except where your local consumer laws require otherwise.
